Master Terms & Conditions for Workwalaa

Workwalaa (“Platform”) is operated by Conecxia Enterprises LLP, a Limited Liability Partnership registered under the laws of India, having LLPIN [●] (“Workwalaa”, “we”, “us”, “our”).

By accessing or using the Workwalaa mobile applications, website, or services (collectively, the “Platform”), you (“User”, “you”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Platform.


1. Definitions

  • Candidate / Worker: Any individual seeking employment or work opportunities through the Platform.
  • Employer / Client: Any individual, company, HR agency, or business seeking to hire candidates or workers.
  • Premium Client: Employers opting for paid screening or verification services.
  • Services: Technology enabled facilitation, discovery, and matching services only.

2. Platform Nature & Role Disclaimer

Workwalaa is a technology enabled facilitation platform only.

Workwalaa does not act as:

  • an employer
  • an employee
  • a manpower agency
  • a recruitment agent guaranteeing employment

Workwalaa does not control:

  • hiring decisions
  • employment terms
  • salaries
  • workplace conduct

All hiring, engagement, and employment relationships are strictly between Employer and Candidate.


PART A: BLUE COLLAR / GIG SERVICES

(Short term, daily wage, contract, and task based work)

A1. Scope

Workwalaa facilitates short term and gig based work connections between Clients and Workers.

A2. No Employment Relationship

  • Workwalaa is not an employer
  • Workers are not employees, agents, or representatives of Workwalaa
  • Clients are solely responsible for labour law compliance

A3. Payments

  • Payments for work are made directly between Client and Worker
  • Workwalaa does not handle job wages
  • Platform fees may be collected through Worker Coins (Worker Coin Wallet Terms apply separately below.)

PART B: WHITE COLLAR RECRUITMENT SERVICES

(Long term employment, corporate hiring, professional roles)

B1. Scope of Services

Workwalaa provides candidate discovery, screening (where applicable), and profile sharing services.

Workwalaa does not guarantee:

  • job offers
  • interviews
  • hiring
  • candidate performance
  • retention or continuity of employment

B2. Screening & Verification Disclaimer

Standard Services

Workwalaa performs no mandatory background verification by default.

Premium Client Services

For Premium Clients only, Workwalaa may conduct:

  • basic education verification
  • prior employment verification

Such verification:

  • is based on documents and data provided by the Candidate
  • does not constitute a legal, criminal, or forensic verification

Workwalaa does not guarantee the absolute accuracy of verification results.

⚠️ Final responsibility always remains with the Employer.

B3. Employer Responsibilities (Mandatory Clause)

Employers expressly agree that they are solely responsible for:

  • identity verification
  • education and credential validation
  • criminal background checks
  • reference checks
  • statutory and labour law compliance

Workwalaa shall have ZERO liability for:

  • theft
  • fraud
  • misrepresentation
  • misconduct
  • data misuse
  • workplace incidents
  • financial or reputational loss

Hiring decisions are taken entirely at Employer’s own risk.

B4. Candidate Responsibilities

Candidates acknowledge that:

  • Workwalaa does not guarantee employment
  • Shortlisting and profile sharing is at Workwalaa’s sole discretion

Candidates cannot challenge:

  • rejection
  • non-shortlisting
  • prioritisation logic

Candidates must independently verify:

  • employer legitimacy
  • job role
  • compensation
  • offer authenticity

B5. Candidate Success Fees

Candidates may be charged a success based facilitation fee.

  • Fee becomes payable only after successful joining.
  • Payment must be completed within 30 days of joining, preferably near the first salary cycle.

The fee is non refundable, except where:

  • the Candidate joins and the Employer fails to pay any salary
  • In such case, the fee shall be refunded.

No refund shall be provided if termination occurs due to:

  • performance issues
  • misconduct
  • voluntary resignation

B6. Employer Fees

  • Employers shall pay a service fee only after successful hiring.
  • Fees are charged per hire, unless otherwise agreed in writing.
  • Employer fees and Candidate fees are independent and non interchangeable.

B7. Replacement Policy

  • Employers may request a replacement within 7 days of joining.
  • Workwalaa shall attempt to provide a suitable replacement.
  • If replacement is not feasible, 100% of Workwalaa’s service fee shall be refunded.
  • No replacement or refund applies after the 7 day period.

B8. Hiring Control & Discretion

Workwalaa retains sole and final discretion, based on internal assessment parameters, to:

  • shortlist candidates
  • prioritise profiles
  • decide which candidates are shared

Such discretion is non challengeable.

B9. Data Sharing & Responsibility

Once candidate data is shared:

  • Employer assumes full responsibility for storage, usage, and compliance.

Workwalaa bears no responsibility for:

  • data retention
  • misuse
  • leaks
  • regulatory non compliance by Employer.

WORKER COIN WALLET: TERMS & CONDITIONS

(As previously approved, unchanged except alignment)

  • Worker Coins are digital platform credits
  • Not legal tender
  • Non transferable
  • Non refundable except at Workwalaa’s discretion
  • Subject to expiry, suspension, or reversal
  • Workwalaa retains full control over Worker Coin issuance and valuation.

3. Limitation of Liability

To the maximum extent permitted by law:

  • Workwalaa’s total liability, if any, shall not exceed the platform fees paid in the preceding 3 months
  • Workwalaa shall not be liable for indirect, incidental, or consequential damages

4. Account Suspension & Termination

Workwalaa may suspend or terminate access for:

  • policy violations
  • fraud or misuse
  • legal or compliance risks

5. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts at Ernakulam, Kerala shall have exclusive jurisdiction.

6. Updates to Terms

Workwalaa may modify these Terms at any time. Continued use constitutes acceptance.
